Litigation Record

Litigation management and strategic advice
High profile cases and complex litigation are what distinguishes Gary’s background. He has experience in courtrooms across the United States and recently recovered $900 million in a fraud case involving a major European bank and one of the largest life insurance companies in the U.S. The case attracted media attention ranging from major French publications to the Wall Street Journal to Los Angeles Times and provided more than 330,000 insurance policy holders with their successful day in court.

Insurance regulation and coverage
Fontana’s knowledge is broad, reaching into every aspect of insurance law and regulation.

What better testament to his expertise: He won a $1.3 billion case against the California Department of Insurance in 1991. Today, the Commissioner of Insurance is one of his clients. Gary has litigated a wide variety of coverage cases for and against insurance companies and has advised carriers and their boards of directors in dealing with rate regulation, insolvency and insurance unfair practice laws.

Energy and environmental regulation
Having served in the Carter Administration as an advisor to James R. Schlesinger, Fontana helped enact some of the nation’s most important energy and environmental statutes – including Superfund and PURPA. He has extensive experience in California and Hawaii with environmental regulation and its application to the permitting of industrial and communications facilities.

Antitrust and unfair competition litigation
Gary began his career as an antitrust litigator. He remains active in the field advising business groups on the application of state and federal antitrust statutes to marketing programs and other business activities.
